Terms and Conditions

Users of Moonglade Travel, LLC services, and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using, or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“Client” and “passenger” and “you/your”) agree to be bound by these terms.

PLEASE READ THE TERMS BEFORE USING THIS WEBSITE. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE THIS WEBSITE OR THE SERVICES OF Moonglade Travel, LLC.

No alterations to these terms and conditions may be made by a Moonglade Travel, LLC representative or agent, unless the approval of the alteration in writing by the authorized officer of Moonglade Travel, LLC.

COST OF SERVICES

Depending on the type of travel planning services rendered, Moonglade Travel requires an upfront fee in order to perform the professional services required to plan and arrange your travel. This fee is separate from the total cost of the trip and must be paid prior to any travel planning, research, booking, or additional consulting services commencing. With each Planning Fee, you ("the Client") will receive a combination of three (3) proposals (i.e., three destinations and no revisions, one destination and two revisions, two destinations and a revision of one, etc.). 

After receiving your customized proposal, if you choose to cancel your travel plans, book your travel arrangements yourself with an online booking site (i.e. Expedia, Travelocity, etc.) or with another travel professional, the Planning Fee is non-refundable, non-transferable, and retained by Moonglade Travel LLC for services rendered. All travel proposals are valid for 30 days. If your customized vacation is not booked within 30 days, a new Planning Fee will be assessed. Additional quote revisions & requests for a different destination are subject to an additional Planning Fee of $50. The additional planning fee is non-refundable and non-transferable.

      • Complimentary when the client specifies the desired property and dates

      • $100 per trip if there is research involved in finding you the perfect property. This covers up to 5 hotels in one location.

    • Villa Rentals

      • Villa bookings will be charged an additional fee of $300 to cover the additional time and resources required to navigate the challenges of vetting a luxury villa.

    • Concierge Services

      • Our concierge services start at $30 per reservation. We’ll assist with additional details such as dining reservations, spa appointments, tee times, theater tickets, etc. to enhance your travel experience.

  • Custom Planning Services 

    • Below is an outline of our fees for most trips, though they may be customized based on trip complexity, duration, and number of travelers.

      • $350 for a trip that is 1-3 nights

      • $500 for a trip that is 4-10 nights

      • $750 for a trip that is 11-14 nights

      Please note:

      • Fees are based on 1-5 travelers in the same household. 

  • Corporate/Incentive Travel – Starting at $2500

  • Destination Wedding/Vow Renewal – Consult with a Travel Advisor

  • Wellness Group (10 + people) – Consult with a Travel Advisor

*Planning Fee is subject to change based on the complexity of the itinerary and at the discretion of management. 

PRICE QUOTES

Price quotes for travel are not guaranteed until reservations are confirmed with full passenger names and deposit payment. Quotes on airfare are not confirmed until paid in full or the required deposit is collected and can change without notice. All prices are subject to change without notice and are subject to availability. Unless otherwise noted, price quotes typically do not include airfare, baggage fees, gratuities, meals, telephone calls, resort fees, incidental items, souvenirs, airport transfers, or travel insurance.

We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed.  We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.

DEPOSITS AND PAYMENTS 

You will be required to pay a deposit or make full payment for your booking at the time of booking. The deposit amount varies depending on the Product booked and the supplier’s deposit requirements. Where you only pay a deposit you must pay the full balance by the balance due date notified to you. Unless otherwise defined during the reservation process, final payment is due prior to departure in accordance with each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. With advanced planning (6 months or more), flexible payment options are available for most vacation packages. We require a minimum payment of $150 for weekly/monthly payments to be set up. 

If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. As a result of such cancellation, Moonglade Travel and third-party supplier cancellation penalties will apply.

Upon receipt of your payment information, you are authorizing Moonglade Travel to make the payment arrangements with the corresponding Suppliers on your behalf. Payments can be made using major credit or debit cards. Cash and checks are not excepted. 

*Airfare is non-refundable after a 24-hour booking window.

CANCELLATION POLICY - EFFECTIVE 1/31/2023 

All cancellations or no-shows are subject to penalties imposed by Moonglade Travel, LLC and the Supplier. When a reservation is canceled by the client, this results in a financial cost to our agency arising from the loss of commission that would otherwise be available as compensation to our agency and our advisors for their time and expertise in advising on and booking travel arrangements on a customer’s behalf. In this regard, after initial payment for all travel types, clients who voluntarily request modifications to their vacation resulting in a cancellation of their booked trip, Moongalde Travel, LLC will impose a trip cancellation fee of $100 per person with a maximum cancellation fee of $500.00 per booking. 

Moonglade Travel, LLC cancellation fees will be charged to the credit card you are authorized to pay for travel services. Supplier policies regarding cancellation fees will be relayed to all clients in your trip documents. All cancellation requests must be sent to Moonglade Travel, LLC in writing via email to info@moongladetravel.com. Verbal cancellations will also be accepted.  

Moonglade Travel, LLC requires payment of the above cancellation fee prior to submitting a separate cancellation request to the travel supplier. Each adult who has made payments toward the reservation balance and wishes to cancel must submit a separate cancellation request. All cancellation fees by all parties listed on the same reservation wishing to cancel must be received before a cancellation request will be submitted to the supplier. These fees are in addition to any cancellation penalties that may be imposed by the travel supplier. These fees are also separate from the cost of the trip. An invoice will be emailed to each party listed on the reservation for payment. 

Any refunds (if any are due to you) for payments will be processed by the travel supplier if payments were processed directly through them and/or your travel protection if you elected to purchase it based on the terms and conditions. All payments processed directly through Moonglade Travel, LLC are nonrefundable and should be included under your travel protection plan in order to receive your money back per their terms and conditions. Cancellation fees charged by Moonglade Travel, LLC may or may not be covered by travel protection plans. Moonglade Travel, LLC is not responsible for any cancellation fees charged by the travel supplier. 

Please consider protecting your investment by securing travel protection. 

CUSTOM TOUR CANCELLATION POLICY 

Moonglade Travel, LLC crafts custom group experiences and reserves the right to cancel any Custom Tour for any reason. In the rare event that Moonglade Travel, LLC must cancel a Custom Tour, all trip members will be notified immediately and will receive a partial refund of payments made to Moonglade Travel. Please note that because Moonglade Travel, LLC Custom Tours are limited to a small number of attendees our cancellation policy is in place to help clients and us alike work together in sharing expenses that may arise from unexpected cancellations.

Exceptions cannot be made for any reason, including weather, injury/illness, or personal emergencies. No refunds or credits for failure to attend or failure to complete the retreat, or for arriving late or leaving early.

Moonglade Travel, LLC is not responsible for expenses incurred by guests in preparing for a canceled tour, including, but not limited to, nonrefundable airline tickets, visa fees, inoculations, equipment, etc. 

  • Deposits are non-refundable

  • 90 to 61 days before departure is 25% of the trip price

  • 60 to 46 days before departure is 50% of the trip price

  • 45-0 days prior to departure is 100% of the trip price

CHANGE FEES

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Due to supplier (s) policy(ies) or time restraint(s), certain bookings may not be changed. Administrative charges of $25 per change/per person are advised at the time of booking, provided to you upon confirmation, and depend upon the circumstances of the request. All desired changes must be sent via email to Moonglade Travel, LLC at info@moongladetravel.com. Changes will not be processed until the $25 administrative charge has been paid. These fees are in addition to any change fee penalties that may be imposed by the travel supplier. 

TRAVEL INSURANCE

For your protection, travel insurance is strongly recommended. However, no representation or description of the insurance made by Moonglade Travel, LLC to you constitutes a binding assurance or promise about the insurance. Moonglade Travel, LLC is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy. Travel insurance may be purchased to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency. Moonglade Travel, LLC recommends that you purchase travel insurance for your trip. If travel protection is declined, you acknowledge and accept liability for any cancellation penalties, damages, and/or out-of-pocket expenses incurred.

CREDIT CARD BOOKINGS

While we do accept major credit cards including Visa, Mastercard, American Express, and Discover, clients must provide us with a click or signed authorization for every transaction for their trip. The authorization is an agreement for us to charge your card and an acknowledgment and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks. 

In certain cases, you have the ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Moonglade Travel, LLC retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper and we retain the right to investigate and rebut any such chargeback claims:

•Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.

•Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.

•Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.

•Chargebacks resulting from force majeure or other circumstances that are beyond the control of Moonglade Travel, LLC or the Supplier.

•Chargebacks result because you do not agree with the cancellation policy.

REQUIRED IDENTIFICATION

Photo identification is required for all travel. Passports are required for international travel and some countries require a visa. Passports are required to be valid for at least 6 months after the date of travel. Some countries require a full blank “VISA” page in the passport for stamping purposes. Any information provided in the travel description pertains to US citizens only. Travelers will not be permitted to depart without proper identification. It is the traveler’s responsibility to verify and obtain any required identification prior to travel commencing. 

Passengers are required to immediately review all aspects of their booking to verify (but not limited to): Legal first and last names, mailing addresses, email addresses, telephone numbers, dates of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please check with the U.S. Department of State for more information related to your travel destination. Special documentation is required for minor children traveling with or without their parents. If traveling with children, please check with the supplier before departure for any specific policies or restrictions. Non-U.S. citizens must contact the consulate of any countries they are visiting to verify any visa requirements. Non – U.S. citizens residing in the U.S. must also contact the U.S. Citizenship and Immigration Services for re-entry requirements into the U.S. further information is on the U.S. State Department website at http://travel.state.gov. Immunizations may also be required. Failure to comply with these regulations may result in denied boarding, denied entry, and/or government-imposed fines. If a Passenger is a citizen of a country other than the United States, there may be additional requirements. Check with the nearest consulate or embassy of the travel destination to find out the entry requirements for non-U.S. citizens.

AIRLINE CONFIRMATION, CHECK-IN, SEAT ASSIGNMENTS, MISSED FLIGHTS

It is important that you confirm your flights with the airline prior to departure: 24 hours in advance for domestic flights and 72 hours in advance for international flights. Failure to confirm international flights or failure to use any portion of an airline reservation may result in automatic cancellation by the airline for all continuing and return flights. 

Familiarize yourself with your airline’s policies and requirements before booking. Unless stated otherwise by the airlines, it is important to arrive at the airport at least 2 hours prior to departure for domestic flights and 3 hours prior to departure for international flights. Late arrival at the airport can result in loss of assigned seats or denial of boarding. Denial of boarding is not eligible for refund or travel insurance reimbursement. Airfare rebooking is subject to airline penalties, rebooking fees, plus any cost difference of the new flight. Seat assignments are subject to change by the airline without notice.

The Transportation Security Administration (TSA) requires passengers to carry a government-issued identification card or passport in order to board a flight. Be advised that the name, date of birth, and gender that appears on the identification card or passport must exactly match the same data that is listed on your airline ticket and in your booking records. Be advised that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss my flight. 

ACCOMMODATIONS & ACTIVITIES

Moonglade Travel, LLC makes no guarantee that its descriptions and photographs are an exact representation of the particular rooms/activities offered. Moonglade Travel, LLC makes no guarantee about the suitability or availability of accommodations, and if the particular accommodations sought are unavailable, we will do our best to reserve comparable accommodations, if possible.

CHANGES TO ITINERARIES

Moonglade Travel, LLC reserves the right to make changes to its published itineraries that we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services. 

While no changes are anticipated, there may be occasions when certain alterations become necessary.  These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, acts of God, or any other reason. Moonglade Travel, LLC reserves the right to change the itinerary due to unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites.  No tours will be canceled due to renovations, although Moonglade Travel, LLC may choose to amend itineraries for such sites.   These changes will not be considered material changes and will not be considered cause for cancellation by the guest.  

If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement.  In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

NO REFUND FOR UNUSED ARRANGEMENTS

As Moonglade Travel, LLC prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while the trip is in progress, there is no refund for the unused portion.

FORCE MAJEURE

Moonglade Travel, LLC assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Moonglade Travel, LLC that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by Moonglade Travel, LLC.

DISCLAIMER OF LIABILITY

Moonglade Travel, LLC acts as a sales and booking agent for any airline, hotel, car rental, tour operator, cruise line, or another service provider which requires that you agree to the terms in this Agreement. Moonglade Travel, LLC is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules. While Moonglade Travel, LLC prides itself on selecting top-quality suppliers, no undertaking, guarantee, or warranty is given or shall be implied as to the fitness or condition of the supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied. 

Please notify Moonglade Travel, LLC immediately if any omissions and/or corrections are needed regarding the booking details. All passengers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Be aware that discounted fares typically involve restrictions, and that changing any aspect of my travel arrangements may result in the payment of additional money. 

Passenger(s) acknowledge and agree that Moonglade Travel, LLC shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall Moonglade Travel, LLC be liable for any accident or injury which occurs in hotels, in resorts, on airplanes/in airports, on buses/in the bus stations, on trains/in the train stations, onboard a cruise ship, on tenders, onshore excursions, or during any mode of transportation encountered during the trip, resulting from any cause. Passenger(s) admits a full understanding of the nature and character of the mode of transport and assumes all risk of travel, transportation, and handling of Passenger(s) and baggage.

Without limitation, Passenger(s) assume the risk of, and agree that Moonglade Travel, LLC is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rules of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collisions, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolts of crew, or lost/damaged/delayed, flights, connections, transfers, or luggage.

NON-RESPONSIBILITY

Moonglade Travel, LLC, its employees, shareholders, agents, and representatives use third-party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this tour. Moonglade Travel, LLC is an independent contractor and is not an employee, agent, or representative of any of these suppliers. Moonglade Travel, LLC does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurant, or any other entity that supplies services related to your tour. All suppliers are independent contractors and are not agents or employees, or representatives of Moonglade Travel, LLC. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither Moonglade Travel, LLC, nor its employees, agents, or representatives are nor may be liable for any loss, injury, or damage to any tour traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Moonglade Travel, LLC. Moonglade Travel, LLC assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; Moonglade Travel, LLC assumes no responsibility or liability for personal property; and Moonglade Travel, LLC shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, an act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Moonglade Travel, LLC accepts no responsibility for lost or stolen items. Moonglade Travel, LLC reserves the right to refuse any traveler or potential traveler at its sole discretion.

ASSUMPTION OF RISK/WAIVER

The client is undertaking the trip, which may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Moonglade Travel, LLC and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

The client understands the description of these risks, is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of this trip, the client is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. The client hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release Moonglade Travel, LLC from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of Moonglade Travel, LLC and traveler hereby covenant not to sue Moonglade Travel, LLC for any such claims or join any lawsuit or action that is suing Moonglade Travel, LLC. This agreement also binds your heirs, legal representatives, and assigns.  The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. 

INDEMNIFICATION

The client agrees to and shall indemnify and hold harmless Moonglade Travel, LLC, and each of our officers, directors, employees, and agents (collectively “Moonglade Travel”), from any expenses, losses, liabilities, damages, judgments, settlements, and costs (collectively, “damages”) involved with or incurred by Moonglade Travel, LLC (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) client’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by the client while participating in the trip.

BAGGAGE FEES

Due to continual changes in airline baggage policies, it is suggested that you inquire with your airline's website for up-to-date fees & information. Moonglade Travel, LLC is NOT responsible for additional fees incurred for baggage or seating. 

PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES

The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our trips. 

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. Moonglade Travel, LLC will communicate requests to Suppliers, but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.

Our Suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify Moonglade Travel, LLC at the time of booking of the status and the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

PHOTOGRAPHIC/VIDEO LIKENESS

The client hereby gives consent to Moonglade Travel, LLC to publish any photographs and/or videos of the trip or client in printed or electronic media without obtaining further consent and without compensation. Each client releases Moonglade Travel, LLC and its representatives from any liability in connection with any use of such photographs and/or video.

CLASS ACTION WAIVER/LIMITATION OF DAMAGES/NOTICE OF CLAIM

You agree that you will only bring claims against Moonglade Travel, LLC in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Moonglade Travel, LLC shall not, in any case, be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Moonglade Travel, LLC unless you have first provided a typewritten notice of claim to Moonglade Travel, LLC within 30 days after the trip or cancellation of the trip.

ENTIRE AGREEMENT

This agreement, including any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Moonglade Travel, LLC. If any provision of these Terms shall be unlawful, void, or for any unenforceable reason, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

DESTINATIONS AND DOCUMENTATION

Travel to certain destinations may involve greater risk than others. Moonglade Travel, LLC urges the client to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. It is your responsibility to be aware of any and all requirements for admittance to a country or state, including Covid-19 requirements. Should you choose to travel to a country that has been issued a travel warning or advisory, Moonglade Travel, LLC will not be liable for damages or losses that result from travel to such destinations. 

It is the responsibility of each client to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements, US citizens should visit www.travel.state.gov. When traveling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. Moonglade Travel, LLC strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted unless authenticated and verified consent forms are provided to the authorities. 

Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/. 

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing the client to miss flight(s), and subsequent scheduled travel bookings tours.  Moonglade Travel, LLC bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

COVID-19 DISCLAIMER

COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and those with underlying medical conditions are especially vulnerable. There is an inherent risk of exposure to COVID-19 in any public space where people are present.

While traveling you voluntarily assume all risks related to exposure to COVID-19, and any other airborne viruses. Moonglade Travel, LLC is not liable if you become sick or contract COVID-19 during travel. Moonglade Travel, LLC strongly recommends each client assess their level of risk tolerance. If traveling outside of North America, you are responsible for checking all travel-related requirements of the countries you are visiting and will be 100% liable for any paperwork, testing, and testing procedures required by each country, state, or province of the local laws in each country. Any disrupted travel due to non-compliance with countries protocol due to COVID-19 is the full responsibility of the traveler. 

We urge you to check the latest guidance from the CDC and the State Department travel advisories and review the individual supplier’s websites before traveling (CDC: https://www.cdc.gov/coronavirus/2019-ncov/travelers/travel-in-the-us.html and State Department: https://covid19.state.gov/). 

GOVERNING LAW/SUBMISSION TO JURISDICTION. JURY WAIVER/NOTICE OF CLAIM.

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of North Carolina exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in North Carolina. You agree that you will only bring claims against Moonglade Travel, LLC in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Moonglade Travel, LLC shall not, in any case, be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Moonglade Travel, LLC unless you have first provided a typewritten notice of claim to Moonglade Travel, LLC within 30 days after the trip or cancellation of the trip.
